In compliance with the provisions of the Mexican Federal Law of Protection of Personal Data in Possession of Individuals (from now on "The Law"), we at this moment inform you of the following:

El Santuario Resort & Residences, indicating the effects of this Privacy Notice, is located at Carretera Colorines km. 4.5, San Gaspar, Valle de Bravo, Edo. de México, C.P. 51230, will be responsible for Personal Data provided by the individuals to whom such data correspond (from now on "The Holder"), for itself or for any of the mercantile societies that are its controllers, subsidiaries or affiliates.

The handling of The Holder's Personal Data made available to El Santuario may be done according to the present terms and conditions under any form or circumstance. Therefore, from this moment, it is understood that The Holder gives his consent for such handling. The Personal Data Holder guarantees that under no circumstances will it be false and that he/she will inform El Santuario of any modification that such data may undergo to keep the information updated.

Personal Data information collected by El Santuario directly from the Holder, with its full consent, will have the use that, in an enunciative but not limiting way, is described as follows: a) Identify you, b) Locate you, c) Communicate and contact you, d) Send you information, e) Statistics, as well as its transmission to third parties by any means allowed by the Law. The use of Personal Data will be directly related to the relationship that the Holder has with El Santuario as a consumer.

The temporality of Personal Data handling of The Holder will depend on the legal relationship celebrated with El Santuario, as well as the obligations demanded by the current legislation and competent authorities. In all cases, the information will be kept only for a reasonable time.

The information given to El Santuario will be adequately guarded, preserved, and protected with adequate technological and physical means to prevent its loss, misuse, alteration, unauthorized access, and theft. Only those authorized by El Santuario will have access to the information, whether they are employees, service providers, or business partners, who have assumed the commitment to keeping the data under a strict confidentiality and security order. For this, El Santuario's employees will sign a Privacy Policy, and suppliers have signed information confidentiality agreements.

In case the Personal Data kept are required by the authority of any kind, either by legal process, to respond to any claim or legal actions or to protect the rights of El Santuario, its clients, and the public, this Personal Data will be made available within the strict compliance of the Law.

The Personal Data Holder will have the right to request access, rectification, cancellation, or opposition of his data through written request generically addressed to El Santuario Resort & Residences, with the address that appears in the present Privacy Notice, from 24 working days, or through a request formulated to our telephone number 726 26 2 9100 or the e-mail fabian@kamish.com.mx, having to have an acknowledgment of receipt. El Santuario Resort & Residences will provide an answer to the requests of The Holder of the information, as long as any of the exceptions contained in The Law is not actualized, and the applicant complies with the requirements contained in article 29 of The Law, which are described below:

I. Indicate the name of the Data Subject and address or other means to communicate the response to the request;

II. Attach the documents evidencing the identity or, as the case may be, the legal representation of The Holder; 

III. The clear and precise description of the Personal Data concerning which it seeks to exercise any of the rights mentioned above;

IV. Any other element or document that facilitates the location of the Personal Data, i.e., to which company of the group they was provided, the person to whom they were delivered, or the area of the company;

In case Holder’s sensitive, patrimonial, or financial data are transferred to any third party, except in case they are transferred to any authority by law or requirement, or due to the fulfillment of the legal relationship celebrated with the Holder and El Santuario Resort & Residences, the Holder will be notified by any means, written, telephonic, electronic, optical, sonorous, visual or any other that the technology allows now or in the future.

If El Santuario Resort & Residences require to use your Personal Data for purposes other than those agreed per the legal relationship with the Owner. In that case, The Owner will be notified in writing, by telephone, electronically, or by any optical, sound, visual, or other means that technology allows now or in the future, and will explain the new uses that it intends to give to the said information to obtain your authorization.

With this Privacy Notice, the Owner of the information is duly informed of the data collected from him and for what purposes, accepting the content terms prepared in compliance with the Federal Law on Protection of Personal Data in Possession of the Individuals.

El Santuario Resort & Residences reserves the right to modify this policy to adapt it to new legislation or jurisprudence, as well as industry practices. In such cases, the changes introduced will be announced on this page reasonably before their implementation.

Likewise, the Owner accepts that all the information added by him or that in turn is obtained through his access to El Santuario Resort & Residents.com.mx will be capable of being compiled and fixed in a database, which will be the property of him. The Holder accepts that, by inserting his information in ostar.com.mx, he grants his express consent referred to in article 76 bis of the Federal Consumer Protection Law so that El Santuario can disseminate and transmit the information inserted in the Database to other providers or competent authorities that require it.
